You can apply for this visa if you are in a relationship (married or defacto) with an Australian citizen, an Australian Permanent resident or an eligible NZ citizen, either same opposite sex.

About the relationship
Not all relationships qualify for a partner visa application. The relationship must be genuine and continuing and you must be able to demonstrate it.
If you are not married, your de facto relationship must have been existing for at least 12 months, unless your relationship has been registered.
